1. INTRODUCTION

1.2. By accessing this website or purchasing a vehicle check, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
1.3. These Terms constitute a legally binding agreement under the laws of England and Wales.
2. DEFINITIONS
“Services” means the provision of vehicle history reports, valuations, and related data provided by us through the website.
“Report” means the digital document or data display containing information about a specific vehicle (identified by VRM or VIN).
“Data Sources” means third-party entities from whom we license or source data, including but not limited to the DVLA, DVSA, Police, insurance companies, and finance houses.
“Consumer” means an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft, or profession.
3. THE SERVICES
3.1. We provide vehicle history checks that may include information regarding: * Outstanding finance; * Insurance write-off status (Categories A, B, S, N, C, D); * Stolen status (Police National Computer); * MOT history and mileage discrepancies; * Import/Export status; * Number plate changes.
3.2. Nature of Data: You acknowledge that the data contained in our Reports is sourced from third-party Data Sources. While we use all reasonable skill and care to ensure the accuracy of the data, we do not warrant that the data is error-free, complete, or up-to-date at the precise moment of access.
3.3. Service Availability: We aim to provide the Services 24/7, but we do not guarantee that the website will be available at all times without interruption. We reserve the right to suspend the Services for maintenance or updates.
4. USER OBLIGATIONS
4.1. You agree to use the website and Services only for lawful purposes.
4.2. You warrant that: * You are at least 18 years of age; * You have a legitimate reason for conducting a vehicle check (e.g., purchasing a vehicle); * You will not use the data for unlawful tracking, harassment, or commercial resale without our prior written consent.
4.3. You are responsible for ensuring the Vehicle Registration Mark (VRM) provided is correct. We are not liable for Reports generated for incorrect VRMs supplied by you.
5. INTELLECTUAL PROPERTY
5.1. All intellectual property rights in the website, the Reports, and the underlying database remain the property of the Provider or our licensors.
5.2. You are granted a non-exclusive, non-transferable licence to use the Report for your personal, non-commercial use (or internal business use if you are a trade user).
5.3. You must not reproduce, redistribute, or publish any part of the Report or the website content without our express permission.
6. PAYMENT AND PRICING
6.1. Prices for the Services are displayed on the website and include VAT unless otherwise stated.
6.2. Payment must be made in full at the time of purchase using the payment methods available on the website.
6.3. We reserve the right to change our pricing at any time. The price applicable to your order is the price displayed at the time you complete the transaction.
7. CANCELLATION AND REFUNDS
7.1. For Consumers: As the Services involve the immediate delivery of digital content, you acknowledge and agree that performance of the contract begins immediately upon purchase. By proceeding with the purchase, you expressly consent to the immediate supply of the digital content and acknowledge that you lose your right of withdrawal (cooling-off period) under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once the download or access to the Report has started.
7.2. Refunds: We may, at our sole discretion, offer a refund if: * The Report was not generated due to a technical error on our part; * The data provided is proven to be materially incorrect at the source level, subject to the limitations in Section 8.
7.3. No refunds will be issued for: * Checks performed on the incorrect vehicle registration number entered by you; * Reports where data fields are empty because no data exists for that vehicle (e.g., a car with no finance history will correctly show ‘No Finance Recorded’).
8. LIMITATION OF LIABILITY AND DISCLAIMERS
8.1. Data Accuracy: We act as an aggregator of data. We do not create the data. Therefore, we accept no liability for any loss or damage resulting from reliance on data that is incorrect within the databases of our Data Sources (e.g., DVLA or Police errors).
8.2. Liability Cap: To the extent permitted by law, our total liability to you in connection with any single Report shall be limited to the price paid for that specific Report.
8.3. Exclusions: We shall not be liable for: * Indirect, special, or consequential losses; * Loss of profit, business, or anticipated savings; * Loss arising from a decision to buy or not buy a vehicle based on the Report.
8.4. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by English law.
9. DATA GUARANTEE (IF APPLICABLE)
9.1. Certain premium reports may come with a data guarantee. If applicable, the specific terms, coverage limits, and claim procedures for such guarantees are set out in a separate “Data Guarantee Terms” document or section on the website. This guarantee is strictly subject to the eligibility criteria defined therein.
10. PRIVACY AND DATA PROTECTION
10.1. We process your personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

11. AMENDMENTS

12. GOVERNING LAW AND JURISDICTION

12.2. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
